Explanation:

The Hyde Beach House project is located at 4010 South Ocean Drive, generally at the northwest corner of Hallandale Beach Boulevard and A1A. The Florida Department of Transportation (FDOT) has requested the Developer, 4000 South Ocean Property Owner, LLLP, to install a southbound right-turn deceleration lane on A1A into the project site and the neighboring property to the north.

The construction of the deceleration right-turn lane has been completed by the Developer. FDOT will be the operating and maintaining agency for the turn lane and requires proper land ownership from the current owner and consent by others having interests in the land within the turn lane limits.

Dated back in 1972, the City was granted easements (uses were not specified) that were recorded in Broward County Plat Book 5046, Pages 280, 283 and 286. With the City’s vested interests in these easements, FDOT has requested the City to execute the attached Subordination of City Utility Interests Agreement, Exhibit “B“. As a result, FDOT will become the owner and operator of the deceleration right-turn lane and the City will maintain rights to the easement in accordance with this Agreement.
