Body

Staff Recommends: Approval of the attached Ordinance.

Explanation:

SECOND READING:
In Section 5.01 corrected language by removing "state statue" and inserting "law."

FIRST READING:
The Charter Review Committee was created for the purpose of conducting a comprehensive study of the City Charter. By a vote of two thirds, the Charter Review Committee may submit proposals to amend or revise the Charter to the City Commission.

The Charter Review Committee must submit to the City Commission any proposed amendments or revisions with associated ballot language no later than the first Tuesday in June. The City Commission shall place the Committee's proposals with the associated ballot language on the ballot.

This proposed Ordinance under Article 5 would clarify ordinance/measure verse petition language. Adds language that Referendum shall not apply to resolutions of the City Commission so long as prohibited by state statute.

This proposed charter amendment would clarify the referendum petition process so that petitions will be submitted to the Office of the City Clerk before obtaining any signatures, and the City Attorney shall indicate whether the language is legally sufficient or insufficient.

Fiscal Impact:
The proposed Charter amendments do not result in significant additional costs.
