SECOND READING:
During first reading (On August 30, 2023), the City Commission approved an interim Resolution (R-2023-258), raising the Parking in Lieu fee to $40,000 per space. Additionally, the Commission requested amendments to the ordinance before its second reading to explicitly state that eligibility for program participation is at the discretion of staff and is not an automatic entitlement.

The revised ordinance now offers clearer definitions of key terms such as Eligibility, Applicability, Application, Decision, and Appeals, relevant to the program's administration. These changes do not change the intent of the ordinance as originally drafted, but provide clarity on how the program operates.

Furthermore, staff is recommending that the Comprehensive Fee Schedule be amended to reflect a fee of $50,000 per space (Companion item: TMP-2024-074).

FIRST READING:
At the March 14, 2023 meeting, the Planning and Development Board acting as the City's Local Planning Agency forwarded a unanimous recommendation of approval for a text amendment to the established Parking Payment in Lieu of Providing Parking Program (? 7.4. of the Zoning and Land Development Regulations).

The intent of this text amendment is to shift all associated fees from the Zoning and Land Development Regulations to the City's Comprehensive Fee Schedule, and there is some general clean-up of language, including clarification of the geographic areas of the Program.
