Explanation:

It is in the best interest of the City of Hollywood Community Redevelopment Agency (“CRA”) to enter into an agreement with a qualified general contractor to provide professional Construction Management at Risk services that are required to implement the Hollywood Boulevard Streetscape project.

 

In accordance with Florida Statute Section 255.103, a governmental entity, including a municipality and a special district, may select a construction management entity pursuant to the process provided by Florida Statute Section 287.055, the Consultants' Competitive Negotiation Act (“CCNA”).  If a governmental entity seeking construction management services chooses to procure such services pursuant to CCNA, it must issue a request for qualifications, review the statements of qualifications, rank the firms, and negotiate with the most qualified firm.

 

On November 15, 2020, the CRA issued RFQ DCRA 20-027 to provide construction management at risk services for the Hollywood Boulevard Streetscape project.  On April 7, 2021, the CRA Board approved  Resolution R-CRA 2021-19, authorizing the appropriate CRA officials to negotiate the Phase I - Pre-Construction Services with the highest ranked firm, and when an agreement was reached, if the contract amount falls within the CRA Executive Director’s authority pursuant to Section 38.38 of the Procurement Code, the CRA Executive Director could execute the agreement; however, if the contract amount exceeded his authority, the agreement was to be brought back to the CRA Board for consideration.

 

Burkhardt Construction Inc., the highest ranked firm, was requested by the CRA to provide fees for the Phase I Preconstruction services. On July 7, 2021, the CRA Board approved Resolution R-DCRA-2021-38, authorizing the CRA officials to approve the expenditure for the Phase I Preconstruction fee in an amount not to exceed $80,000.00.

 

Burkhardt Construction Inc., bid out the project and prepared and submitted a Guarantee Maximum Price (“GMP”) for the construction of the Hollywood Blvd. Project in an amount not to exceed $14,509,809.36.  The CRA requests authorization from the CRA Board to allow for the direct purchase of materials in an estimated amount of $1,832,000 for an estimated sales tax savings in an amount of $121,000.00, and the authorization from the CRA Board to allow for the expenditure of funds for permit fees associated with the construction of the project in an amount not to exceed $400,000.00.

 

Through coordination efforts with Public Utilities, the GMP also includes $1,296,395.65 for cost associated with upgrades to the existing water main system which consists of the installation of a new water main withing the project limits. This cost is to be reimbursed by Public Utilities to the CRA.

 

As such, the agreement is being brought to the CRA Board for consideration.

 

Fiscal Impact:

Funding for this expenditure is available in FY23 operating budget, in account number 166.669902.55200.563010.001349.000.000.
