Explanation:
On March 12, 2019, the City held a Special Election wherein a majority of voters approved funding, through a General Obligation Bond (“GOB”), for the Tidal Flooding Mitigation and Shoreline Protection Project. The project’s purpose was to provide tidal barriers to the City-owned properties most vulnerable to tidal flooding, around the two man-made inlets known as North Lake and South Lake.
On April 22, 2020, under R-2020-072, Cummings Cederberg was selected as the consultant for the Tidal Flooding Mitigation and Shoreline Protection project, including all the City-owned parcels around North and South Lake and shown as 22 parcels in a map that was made part of the Request for Qualifications. A preliminary cost estimate showed that the GOB funds were insufficient to design and construct the needed tidal barriers for all 22 parcels.
The project was divided into 22 smaller projects, matching the parcel map, and classified by phases. Eight locations were classified as Phase 1 projects.
The design consultant agreement, approved under R-2020-275, stipulated that the award for Phase 1 projects be developed from survey, planning, permitting, final design and construction engineering services. Fourteen projects were classified as either Phase 2 or Phase 3 projects. The scope of services included only the development of conceptual designs for Phases 2 and 3. These conceptual drawings were utilized to apply for grant funding.
The Department of Design and Construction Management (“DCM”), on behalf of the City, submitted a grant application to the State of Florida Department of Environmental Protection (“FDEP”) for funding through its Resilient Florida Grant Program in the amount of $14,112,000.00 to assist in funding the design, permitting and construction of Phases 2 and 3 of the Tidal Flooding and Shoreline Protection Project.
The FDEP awarded the City a total of $14,112,000.00 to fund the design documents and construction of the entire Tidal Flooding and Shoreline Protection Project, including Phases 1, 2 and 3. The City will be able to recover 50 percent of the project costs, for all three phases, incurred after the award date of July 1, 2021, up to the grant award total.
In order to meet the FDEP grant requirements, DCM negotiated a scope of work and a fee of $1,833,910.00 with Cummins Cederberg, Inc. for the design, permitting, bidding and construction phase engineering services of the remaining 14 locations identified as Phase 2 and 3 Projects.
The Director of DCM recommends that the City Commission authorize the appropriate City officials to execute the attached Contract Amendment to the Agreement with Cummins Cederberg, Inc. in the amount of $1,833,910.00.

Funding for this project was included in the amended FY 2023 Capital Improvement Plan and is available in account number 333.149901.54100.563010.001187.000.000.
