Staff Recommends: Approval of the Attached Resolution.
Explanation:
Florida Department of Transportation (“FDOT”) is permitted by law to convey and lease real property that FDOT no longer needs and determines to be surplus to other public entities to further the public needs of the State of Florida.
On August 31, 2022, the City Commission approved Resolution No. R-2022-236, which authorized the request of leasing surplus properties from FDOT with the public purpose of proving a pet-friendly walking path.
This Lease Agreement provides for a non-monetary lease between FDOT and the City for a period of 10 years with an option to renew for an additional 10-year period.
Fiscal Impact:
Approval of this Resolution will not fiscally impact the City at this time. The planned park will be developed and maintained by the Beach CRA until its sunsetting.
