Staff Recommends: Approval of the attached Resolution.


Explanation:
In the last several months, the Applicant has received approvals from the Planning and Development Board to rectify violations, bring the property into compliance, and address growing popularity and their desire to formally expand the market. Currently, the Applicant is working with the City to pull all the required permits to complete the improvements that were granted by the Board.

In 2010, the City entered into a Tri-Party agreement with the County and the Applicant (later amended), which restricted the hours of operations of the market based on concurrency fees due to the County. At this time the Applicant wishes to amend the current restricted hours (Attachment I) to allow the market to be open to the public on Saturdays, Sundays, and Legal Holidays only, from 8 AM to 9:30 PM. All other elements of the Tri-Party Agreement would remain as is.

Following consideration by the City Commission, this item would also have to be considered by the County Commission.
