Explanation:
The Applicant, Ocean Drive Commercial Realty Management LLC is proposing to build an approximate 19,000 square foot medical office building (3500 Building). The subject site is zoned Light Intensity Office District (O-1) and Single Family District (RS-5). Although the Zoning District, O-1 allows for the proposed use, the Land Use is Low Residential, which does not. In such cases, the City's Land Use Element states that no more than 5% of an area designated for residential uses within a flexibility zone on the City's Land Use Map may be used for neighborhood office and/or retail sales of merchandise or services. The application of this flexibility rule to change from Residential to Commercial Flex is processed in same manner as a rezoning.

The Applicant is requesting an amendment to change the Land Use designation of the subject site from Residential to Commercial Flex. The total site is 1.4 acres. The building is proposed on the portion of the site zoned O-1 (approximately 1 acre); while accessory parking will be provided on the remaining residentially zoned portion. To protect the neighborhood from commercial intrusion, the flexibility rule shall only be applied to the one-acre portion of the site zoned O-1.
