Explanation:

The Parking Division presented the 2nd reading of PO-2019-22, Revisions to Chapter 72 of the City Code of Ordinances on May 20th, 2020.  The Commission requested changes to the revised ordinance. The item was withdrawn at the Commission meeting to make the requested changes to the revised ordinance and represent the ordinance on 1st reading. Those changes included better definition of a Resident, adding language allowing a condominium board to present documents showing they are voting on behalf of the owners and limiting the length of time for guest permits to be valid.

 

Chapter 72 of the Hollywood Code of Ordinances sets forth regulations and guidelines relating to parking within the City. Changes have been recommended by the recent Barrier Island Parking Study within both the Downtown and Beach areas of the City. There have also been discussions with the Commission to re-evaluate the parking permit program.

 

City staff have reviewed the existing guidelines and regulations and determined that the current provisions need to be updated to coincide with the City’s current visions as well as be consistent.

 

72.001                     DEFINITIONS.

 

Language added to define Beach Residential Parking Permit District, Beach Residential Parking Permit, Employee Parking Permit, Resident, Residential Parking Permit District, Residential Parking Permit and Residential Guest Parking Permit.

 

§72.016                     PARKING, STANDING IN FREIGHT LOADING ZONE.

 

Language added to add flasher requirement and authorize the Parking Administrator to determine necessity and set days and times for loading zones.

 

§72.026                     PARKING PERMIT PROGRAMS.

 

Declaration of necessity and purpose added. Language added to Sections (D), (E) and (F) to clarify Residential and Beach Residential districts, permits and programs.

 

Sections (G) and (H) added to clarify Employee Permit parking and general Parking Permit rules.

 

§72.077                      OVERTIME PARKING.

 

Sections (A) and (B) define eastern and western boundaries of the City for purposes of overtime parking violation enforcement.

 

Section (C) clarifies when a parking permit can be used for metered parking.

 

Section (D) creates separate fine structures for eastern and western parts of the City, similar to on-street parking fees.

 

§72.078                     TRUCKS, TRACTOR TRAILERS, SEMI-TRAILERS AND TRAILERS.

 

Trucks, tractor trailers, semi-trailers and trailers, as defined in Florida Statutes, would not be allowed to park overnight where posted with official signs.

 

§72.111                     RESTRICTIONS ON PARKING VEHICLES.

 

Section (B) (1) adds language concerning unregistered vehicles.

 

Section (B) (2) allows unregistered vehicles to be towed.

 

§ 72.156                     AUTHORITY OF CITY TO USE MOTOR VEHICLE IMMOBILIZING DEVICES.

 

Section (F) increases the boot removal fee from $50 to $75.

 

§72.160                     PARKING ADMINISTRATOR.

 

Language removes old title of Director of the Office of Parking and Intergovernmental Affairs and replaces it with Parking Administrator.

 

§72.999                     PENALTY.

 

Section clarifies penalties for existing violations and adds escalating fines for blocking sidewalk, parking overtime in timed enforcement areas, etc. Language added regarding late fees and collections process.

 

The Parking Administrator recommends approval of the ordinance.

 

Fiscal Impact:

The fiscal impact of the proposed changes to the fee structure is anticipated to be minimal (dependent on the type of violation and location in which the violation occurs).  If a new beach residential permit is enacted, the fee will be established as part of a separate resolution per City ordinance.
