Explanation:
The request is to amend the Chapter 158 of the Code of Ordinances in an effort to provide consistency with the Zoning and Land Development Regulations. This text amendment is a result of discussions amongst City Staff regarding the enclosure requirements for swimming pools.
Inconsistencies with setbacks requirements as well as references to outdated building codes will be addressed with this amendment.
More specifically, the Zoning and Land Development Regulations require a six foot side and rear pool setback and a three foot side and rear deck setback. This is inconsistent with the Code of Ordinance requirement of an eight foot side and rear pool setback and a five foot deck setback. Staff recommends the elimination of the setback requirements from the Code of Ordinance as the Zoning and Land Development Regulations regarding pools has been consistently implemented.
Additionally, the Code of Ordinance currently references specific editions of the Building Code. In recognition that the Building Code is updated every decade, Staff recommends the removal of the reference to a specific edition of the Building and Supplemental Code.
Fiscal Impact:
Approval of this ordinance will not fiscally impact the City.
