Explanation:

Annual fire inspections are mandated under the Broward County Local Amendments to the Florida Fire Prevention Code, Paragraph F-3.5, and Section 94.172 of the City's Code of Ordinances.  By ordinance, the City inspects all residential properties that are part of a building of three or more units and all non-residential properties. 

 

The City is reimposing the fire inspection non-ad valorem assessment for FY 2021.  The fire inspection assessment provides funding for the City’s fire inspection services, facilities and programs and was first imposed in FY 2010.  The assessment pays for a portion of the cost of fire inspection services provided to properties located in the City.  The remainder of the cost is funded from other City revenue sources.

 

The annual fire inspection non-ad valorem assessment is levied against all residential properties that are subject to fire inspections including multi-family, condominium and cooperative properties and all non-residential properties in the City with the exception of government properties with building uses that are exempt from ad valorem taxation under Florida law.

 

The City Commission adopted the Preliminary Rate Resolution for FY 2021 on July 1, 2020 which initiates the annual process for updating the assessment roll and reimposing the fire inspection assessment.  The Annual Rate Resolution sets forth the final fire inspection assessment rate schedule and approves the Assessment Roll for Fiscal Year 2021 with such amendments as the City Commission deems appropriate after hearing the comments and objections of all interested parties.

 

A virtual public hearing will be held on September 14, 2020 at 5:30 p.m. and was properly noticed in the newspaper and by mail as part of the TRIM notice issued by the Broward County Property Appraiser at least 20 days before the virtual public hearing.

 

The proposed FY 2021 assessment rates set forth in the Annual Rate Resolution are the same rates that were approved in the Preliminary Rate Resolution on July 1, 2020. The proposed FY 2021 assessment rates as set forth in the Annual Rate Resolution are expected to generate an estimated $2,168,000 in revenues to the City.

 

Fiscal Impact:

The City Commission enacted procedures implementing a recurring fire inspection special assessment program to provide a portion of the funding needed to support the City’s fire inspection services. Fire inspection assessment are levied against all residential properties of three or more units, and all non-residential properties located in the City.

 

For Fiscal Year 2021, beginning October 1, 2020, the residential rate for the fire inspection assessment for Fiscal Year 2021 will decrease from $28.00 to $21.00. The proposed FY 2021 rates will result in a projected fire inspection assessment roll to be collected of $2,168,000.00. Setting the fire inspection assessment rate at this level will fund approximately 97.5% of the total assessable costs of providing fire inspection services.

 

Total revenue budgeted in the FY 2021 Budget for the Fire Inspection Assessment is $2,059,600.00, which is 95% of the total anticipated revenues of $2,168,000.00.
