Explanation:
On December 14, 2016, the City Commission approved R-2016-347, authorizing the appropriate City officials to apply for and, if awarded, accept the 2016 Florida Department of Transportation Safe Routes to School Grant. The proposed sidewalks will stretch over 13,225 linear feet around various streets within the North Central neighborhood, as shown on the attached map (Attachment 1) west of the Avant Garde Academy in Hollywood. The grant application was based on a City-estimated cost of $500,000.00 for the construction of the new sidewalks.
On June 7, 2017, the Florida Department of Transportation (FDOT) issued an award approving funding for the Avant Garde Academy of Broward Safe Routes to School in the amount of $983,393.00 in fiscal years 2020 and 2022 for the construction of new concrete sidewalks in existing street rights-of-way leading to schools in areas where sidewalks presently do not exist. The FDOT based the grant award on their own Long Range Estimating template for similar projects five years into the future, and based the award on their estimate which they believe to be representative of the cost of the project. The project scope remains the same and the City would be responsible for any cost overruns. The higher FDOT estimate helps to keep the possibility of project cost overruns lower.
FDOT manages the implementation of Safe Routes to School Grants through the FDOT Local Agency Program (LAP), requiring project-by-project agency LAP certification, a process requiring submittal over a one-year period of staff qualifications, progress design plans, National Environmental Policy Act (NEPA) certifications, contract documents, and attendance at FDOT training seminars; leading to a Grant Award Contract if certification is achieved. The costs to secure Local Agency Certification, such as design consultant fees, permit fees, staff time and construction management costs are not reimbursable under the grant award. The grant award will cover the construction costs as a monthly reimbursable costs.
The City desires to hire a Consulting Engineering Firm to provide the survey, design, and NEPA documents as required to achieve project-specific LAP certification for this grant award. Resolution No. R-2018-400, adopted on December 19, 2018, approved a three-year continuing services contract with five firms to provide Professional Engineering Services for the City of Hollywood. Such design contracts are negotiated on an as-needed rotating basis. One of firms approved is Bermello Ajamil and Partners, Inc. (“B & A”), and the executed contract is attached as Exhibit A.
The Department of Design and Construction Management (“DCM”), negotiated a project scope and fee with B & A attached as Exhibit A-1 and A-2, which we believe to be fair and reasonable and in accordance with industry standards.
The Director of DCM and the Director of Procurement recommend the approval, by appropriate City officials, of the execution of a series of Consultant’s Authorizations to Proceed with B & A in the amount of $108,280.00 for the progress design plans, topographic survey, environmental evaluation and cultural resources survey, and construction support, for the Avant Garde Sidewalk Project.
Fiscal Impact
Funding for the design portion of this project is included in the 2020 Capital Improvement Plan and is available in account number 334.149901.54100.563010.001121.000.000. Additional funding in the amount of $225,000 will be requested in subsequent fiscal years for the construction engineering inspections, grant compliance monitoring and construction contingency, subject to the approval and adoption by the City Commission. The grant award contract will cover construction costs up to $938,000.00.
