Explanation:

On May 6, 2005, former police officer Shawn O’Connor (the Claimant) sustained injuries during an interaction with a suspect. The injuries were found to be compensable. He received treatment and continued working until his normal retirement on February 1, 2006.

 

Numerous petitions for benefits have been filed, and the City has paid $104,608.09 on this claim. On September 14, 2017, the Clamant filed a petition for benefits after the statute of limitations had expired. Consequently, the City denied any and all benefits the City litigated the matter, receiving a favorable judgment from the Judges of Compensation Claims, which prompted additional litigation from the Claimant.

 

The City has reached a settlement with the Claimant in the amount of $5,000.00. To halt further litigation and close the Claim, it is in the City’s best interest to settle. Authorization of this settlement would completely close the Claim. The Claimant will be able to treat any conditions, where the industrial accidents are the major contributing cause, under his regular health insurance.

 

 

Fiscal Impact:

Funding for this settlement is available in the FY 2020 Operating Budget account number 558.112006.51900.591930.000000.000.000.
