Staff Recommends: Approval of the attached Resolution.

Explanation:

Eli Polikar filed a civil action against the City of Hollywood and Hollywood Police Officer Roger Stacey, for damages arising out of his arrest that occurred on or about January 1, 2010. In the Third Amended Complaint, Polikar alleges that he was falsely arrested and battered, amongst other torts, when he was arrested for disorderly conduct and battery at 5130 Hills Drive, Hollywood. Attorneys for Polikar, the City and Officer Stacey have negotiated a conditional settlement in the amount of $75,000.00.

The negotiated conditional settlement requires City Commission approval. If approved, the monies will be paid from the City’s self-insurance fund. Further, both the City and Officer Stacey will obtain full releases of liability and no party to the litigation will admit having committed any wrongdoing.

The City Attorney, along with outside counsel, are recommending that the City Commission approve this conditional settlement.
