Explanation:
Fox Rothschild LLP is currently providing legal services to the City in three separate matters as follows:
a) Defending the City in the case of Margaritaville Hollywood Beach Resort, L.P. v. City regarding the payment of transaction rent,
b) Defending the City in the case of Broward County v. City regarding the location of the communication tower,
c) Assisting the City in negotiations for the redevelopment of the City-owned property at 1600 South Park Road.
Section 38.40(C)(2) of the Code of Ordinances exempts from the competitive bid and competitive proposal requirements of the Purchasing Ordinance contracts for professional services. When professional services are purchased and the estimated annual amount to be paid for those services exceeds $50,000.00, City Commission approval is required.
The fees incurred for the three matters listed above are approaching $50,000.00, and the City Attorney estimates that the fees for all legal services provided by Fox Rothschild LLP in FY 2019 will approach but not exceed $85,000.00. The City Attorney recommends that the City Commission approve the expenditure of an amount not to exceed $85,000.00 for legal services provided by Fox Rothschild LLP in FY 2019.
Funding for the fees authorized by this Resolution is available in the Fiscal Year 2019 budget in account number 001.020101.51400.531220.000000.000.
