Explanation:
The Broward County Commission (County) voted on June 5, 2018, to place on the November 6, 2018 ballot, for consideration by the countywide electorate, a proposed transportation surtax levy of 1% to fund county wide transit and transportation improvements. On June 5, 2018, the County also enacted ordinance No. 2018-29, Broward County Transportation Surtax Ordinance, establishing an Oversight Board, an Appointing Authority and providing a process for municipalities to apply for funding including Broward Metropolitan Planning Organization (Broward MPO) review and ranking based on the projects ability to alleviate traffic congestion and enhance connectivity.
On August 21, 2018 the County approved a Transportation System Interlocal Agreement between the County, participating municipalities and the Broward MPO, setting aside 10% of the total surtax for municipal projects and enhanced Community Bus Service. The Interlocal Agreement became effective when, prior to September 30, 2018 the municipalities representing majority of population of Broward County formally approved, executed and returned the executed Agreement to the County. On September 20, 2018, the City Commission adopted Resolution No. 2018-287, approving the Interlocal Agreement.
The voters of Broward County approved the Transportation Surtax on November 6, 2018. The Oversight Board was appointed on January 10, 2019, by the Appointing Authority authorized by the County Ordinance, and has started regular meetings.
On June 11, 2019, the Broward County Board of Commissioners approved the First Amendment to the Transportation Surtax Agreement, removing maintenance and rehabilitation projects from the Broward Metropolitan Organization’s ranking process and allowing for direct submittal by the Municipalities to Broward County, with a separate process to be developed by Broward County based on facility condition, need and population. The First Amendment to the Transportation Surtax becomes effective if both the Broward MPO and more than 50% of the Municipalities (representing more than 50% of the population) approve the amendment.
