Explanation:
Resolution R-2017-008 was approved on January 18, 2017 awarding a construction contract for structural repairs to the Van Buren Parking Garage to Structural Integrity Contractors Inc. The surety company bonding the project is Great American Insurance Company.

In December 2017 it was noted that the contractor was not fully staffing the project. On January 16, 2018 the City received written notice that the surety had received demands against the contractor's bond and that the City should make no further payments to the contractor while the surety investigated the claims.

On or about March 5, 2018 the surety notified the contractor (by letter) that they were in breach of and had defaulted under the contract. At that time, the City was still holding the contract balance of $52,121.27.

The surety then secured a proposal from PRM Engineering and Contracting Inc. to complete the unfinished portion of the project for $137,976.50. The surety has requested the City to enter into a "Tender and Release Agreement" where they will give the City $85,855.23 in order to finish the work and allow the City to enter into a direct contract with PRM Engineering and Contracting, Inc, which is in the best interest of the City, thus completing the project.
