Title
A Resolution Of The City Commission Of The City Of Hollywood, Florida, Approving And Authorizing The Appropriate City Officials To Implement A Settlement For Attorney’s Fees Between Raymond Powers In Reference To A Workers’ Compensation Claim In An Amount Not To Exceed $5,000.00.
Body
Staff Recommends: Approval of the attached Resolution
Explanation:
The City of Hollywood has been advised by its workers’ compensation attorney, Andrew Borah that there are attorney’s fees/costs due and owing to Raymond Powers in relation to his workers’ compensation claim that occurred on October 6, 2006.
Mr. Powers was diagnosed with hypertension. The illness was found to be compensable as Mr. Powers was a firefighter at the time of his diagnosis and passed a pre-employment physical. Hence, it was presumed that his condition was related to his employment. Mr. Powers worked for the City until he reached normal retirement on December 29, 2010 and continues to receive treatment.
To date the City of Hollywood has paid out $180,231.49 for this claim.
It is recommended that the City Commission authorize an amount not to exceed $5,000.00. This amount does not settle the claim; it only settles what is currently due and owing for attorney’s fees/costs.
