Explanation:

The Department of Parks, Recreation and Cultural Arts desires to adjust the annual lease agreement fee for the use of public lands to construct private boat docks to align with current market value.

 

Section 98.051 (B) of the Code of Ordinances provides that the annual lease fee shall be established by Resolution of the City Commission.

 

A survey of dock lease prices in the Broward, Palm Beach and Miami areas was conducted where rental prices ranged from $40 - $2,000 per month.

 

These prices are for rental of private docks, the docks in the dock leases the adjusted fee is referencing were built and are maintained by the lease, which is reflected in the adjusted fee.

 

The lease fee for the construction and maintenance of private boat docks upon City property shall be $2,000.00 per year per dock facility plus the applicable rental sales tax which, shall be due on October 1st of each year during the four year term.

 

The lease fee shall be adjusted annually based on the Consumer Price Index- Urban Areas using the $2,000.00 lease fee as its base plus the applicable rental sales tax and any additional fee increases based upon current market value.

 

The first adjustment shall be equal to the percentage increase, if any, between the August, 2017 CPI and the August, 2018 CPI.

 

Subsequent adjustments shall be made each year thereafter.
