Explanation:
On September 6, 2017, the Mayor of the City of Hollywood, declared a State of Emergency pursuant to state and local law due to Hurricane Irma. The State of Emergency ended September, 14, 2017.
Section 40.08 of the Hollywood Code of Ordinances entitled "Emergency Temporary Housing" expressly provides that upon a declaration of a state of emergency and during the pendency thereof, and as part of the original declaration or at any time during the duration of a declared state of emergency, the City Commission may declare a state of housing emergency for all or any part of the city. On September 6, 2017, the City Commission passed and adopted Resolution No. R-2017-272 wherein the City Commission determined it was necessary and prudent to preemptively declare a state of housing emergency for the entire boundaries of the City of Hollywood.
A housing emergency declaration survives the termination of a State of Emergency and may only be terminated, in whole or in part, by formal action of the City Commission as set forth in Section 40.08 of the Hollywood Code of Ordinances. The status of the housing emergency shall be evaluated ninety (90) days after its declaration by the City Manager or his/her designee, as long as the housing emergency declaration is in effect, to determine whether formal action by the City Commission is necessary.
