Staff Recommends: City Attorney’s Office and the Dept. of Parks, Recreation and Cultural Arts recommend approval of the attached Resolution.

 

 

Explanation:

Sections 98.100 through 98.105 of the Hollywood Code of Ordinances establish regulations for the use of the Hollywood Marina by vessel owners.  In order to utilize the Hollywood Marina, a vessel owner is required to execute a dockage agreement and pay the required dockage fees.  In the event that the vessel owner breaches the terms and conditions of the dockage agreement, the City is entitled to remove the vessel from the facility, and recover either in rem or in personam, the outstanding dockage fees, removal and storage costs under state or federal law. 

 

Recently,  there has been an increase in vessel owners breaching their agreements and demand letters were sent to the vessels owner, however, payment of the delinquent fees have not been satisfied by the owners.  Thus, the Department of Parks, Recreation and Cultural Arts has requested that the City Attorney’s Office pursue recovery of the delinquent fees as well as possibly obtaining ownership of the vessels.
