Explanation:

The City of Hollywood adopted Ordinance No. O-2013-06 on February 20, 2013 amending Chapter 38 of the Code of Ordinances to establish the authority and process for levying and collecting nuisance abatement non-ad valorem special assessments for remedial work performed by the City related to abandoned real or personal property, overgrown grass and debris removal, swimming pools posing public safety hazards, unsafe structures, and other related activities.

 

Resolution No. R-2013-044, also adopted on February 20, 2013, declared the City's intent to use the uniform method of collecting the nuisance abatement special assessments in accordance with Section 197.3632, Florida Statutes, as amended, because the uniform method enables such special assessments to be collected on the annual property tax bill.  The City has also entered into agreements with the Broward County Property Appraiser and Broward County to provide the administrative services necessary for the City’s use of the uniform method of collecting the assessments.

 

This Preliminary Assessment Resolution, as defined in and required by Ordinance O-2013-06, initiates the annual process for levying and collecting cost incurred by the City over the preceding 12 months which have remained unpaid and become liens against the property.

 

Florida Statute Section 197.3632(4)(a) prescribes certain steps that governments must take in utilizing the uniform collection method to place a non-ad valorem assessment on the property tax bill, including the preparation of an assessment roll to be adopted at a public hearing no later than September 15 and the provision of notice of the public hearing.  The purpose of this resolution is to direct the preparation of such assessment roll, and to authorize the required public hearing and the related notice that is required.

 

The City Commission of the City of Hollywood, Florida, deems it to be in the best interest of the citizens and residents of the City to adopt this preliminary assessment resolution.

 

The preliminary roll (Appendix "A" of the resolution) is projected at this time to consist of 104 properties with assessments totaling $53,250.32.  Total revenue to be budgeted in the Proposed FY 2018 Budget for nuisance abatement assessments is $30,000.00 reduced for anticipated interim collections.  Property owners who pay their assessments between now and when the annual property tax bills are issued will be removed from the roll.
