Explanation:
On March 15, 2017, the City Commission passed and adopted Resolution No. R-2017-066, authorizing the expenditure of State Law Enforcement Funds in the amount of $20,181.18 to defray the expenses/costs associated with the seizure and processing of forfeiture cases. Since March 15, 2017, there has been an increase in forfeiture cases whereby the expenses/costs associated with such cases requires additional expenditure of funds. . As a part of forfeiture proceedings, there are pre-suit costs as well as costs associated with initiating and pursuing forfeiture actions, including but not limited to court filing fees and public notices. Currently, in processing forfeiture cases, the City is required to pay filing fees for each case in the approximate amount of $1,000.00, post a bond in the amount of $1,500.00, and incur mailing costs.
The attached Resolution seeks City Commission authorization to increase the expenditure amount of State Law Enforcement Forfeiture Funds to defray expenses/costs associated with the seizure and processing of Forfeiture cases from $20,181.18 to $70,181.18.
The expenditure of Law Enforcement Forfeiture Funds to defray the costs associated with the seizure and processing of forfeiture cases will incur no cost to the taxpayers of the City of Hollywood and this expenditure serves a legitimate law enforcement purpose as prescribed by Section 932.7055(5)(a), Florida Statutes.
