Staff Recommends: The Approval of the Attached Resolution

 

 

Explanation:

The Police Department desires to purchase two (2) transport vans and  associated equipment in order enhance the safety, reliability, operational efficiency and performance capabilities of the Special Weapons and Tactics Unit (“SWAT”).

 

The existing transport vans are 13 years old and are constantly in need of repair.                                          

 

The SWAT unit is utilized in high risk situations and SWAT personnel rely heavily on their transport vans to facilitate these high risk operations.

 

The Department of Justice’s Equitable Sharing Guidelines (“Guidelines”) sets forth that Federal Law Enforcement Forfeiture Funds may be expended on permissible uses such as the costs associated with the purchase, lease, maintenance, or operation of law enforcement equipment for use by law enforcement personnel that supports law enforcement activities, provided that the purchase is not a budgeted item and it is not supplanting a normal operating need/expectation of the law enforcement agency.

 

The Guidelines require that the Police Department obtain approval for such expenditures from the City Commission.

 

The funding source for the purchase of the aforementioned equipment will be Federal (Justice) Law Enforcement Forfeiture Funds pursuant to the Federal Comprehensive Crime Control Act of 1984, thereby incurring no cost to the taxpayers of the City of Hollywood and such expense is a permissible use of such funds.

 

The Ford T350 transport vans are available through the State of Florida Bid No. 25100000-16-1 which was competitively bid and said contract may be used and relied upon by other governmental entities within the State of Florida.

 

Garber Ford has agreed to provide the two transport vans under the same pricing, terms and conditions to the City of Hollywood.

 

The interior vehicle equipment is available through the Broward Sheriff’s Office RLI - 16016IC which was competitively bid for specialty fire apparatus and police emergency equipment (which includes interior outfitting only) and awarded the emergency equipment contract to Emergency Vehicle, Inc.

 

Emergency Vehicle, Inc. has agreed to provide the emergency interior police equipment package under the same pricing, terms and conditions to the City of Hollywood.

 

On August 31, 2016, the City Commission passed and adopted Resolution No. R-2016-252, which authorized the issuance of Blanket Purchase Order Number B002721 to Strobes-R-Us, Inc. for the Purchase, Supply and Installation of Emergency and Related Equipment, whereby, the purchase of the emergency light package in the amount of $7200.00 falls under said Blanket Purchase Order in accordance with Section 38.40(C)(5) of the Purchasing Ordinance and this purchase does not require City Commission approval.

 

Section 38.40 (C)(5) of the Purchasing Ordinance allows the Director to procure, without following formal procedures, all goods and services which are subject of contracts with the state, its political subdivisions, the United States government, other governmental entities, or a corporation not for profit whose members are governmental entities, public officers, or any combination thereof, provided however, the goods and services are: (i) the subject of a price schedule negotiated by the state or the United States government, or (ii) the subject of a contract with another governmental entity or a corporation not for profit whose members are governmental entities, public officers, or any combination thereof, which contract is based strictly on competitive bids or competitive proposals and not on any preference.

 

The Chief of Police recommends that the appropriate City Officials authorize the expenditure of Federal (Justice) Law Enforcement Forfeiture Funds in an amount not to exceed $112,000.00 for the purchase of the two (2) transport vans, emergency light packages, and the interior vehicle equipment.

 

The Fiscal Year 2017 Operating Budget of the City of Hollywood was adopted and approved by the City Commission pursuant to Resolution R-2016-284 at the 2nd Public Budget Hearing on September 28, 2016.

 

This Resolution seeks to authorize the recognition and appropriation of Law Enforcement Forfeiture Funds as detailed in the attached Exhibit 1.
