Explanation:
In 2015, Donald Lheureux filed a civil action against the City for damages arising out of an accident that allegedly occurred on or about August 17, 2013. In his civil action, Mr. Lheureux alleges that he tripped and fell as a direct result of the City’s failure to maintain the sidewalk at or near 5927 Pierce Street. Mr. Lheureux also alleges that this accident caused him to incur medical expenses totaling almost $350,000.00.
The City Attorney and Mr. Lheureux’s attorney have negotiated a settlement in the amount of $100,000.00. If this settlement is approved by the City Commission, the monies will be paid from the City’s self-insurance fund.
The City Attorney recommends that the City Commission approve the negotiated settlement.
