Explanation:

The City is the owner of 5731 Pembroke Road and an adjacent 25' wide vacant parcel. The building is operated as a day care facility known as the Sue Gunzburger-Washington Park Child Care Center pursuant to a license agreement between the City and Washington Park Child Care Center, Inc. dated February 22, 2013.

 

Greater than half of Gunzburger-Washington Park Child Care Center clients are low- to moderate-income (LMI) families and households. Child care is one of the most significant expenses in a family budget, often exceeding the cost of housing, college tuition, transportation, or food. Therefore, the Sue Gunzburger - Washington Park Child Care Center is of considerable benefit to the Washington Park neighborhood and surrounding area.

 

The current License Agreement provides that Washington Park Child Care Center, Inc. is responsible for maintenance of all buildings, grounds and facilities on the premises at its sole expense. However, certain repairs to the premises need to be undertaken immediately and Washington Park Child Care Center, Inc. lacks capital to undertake the project. Therefore, Washington Park Child Care Center, Inc has requested financial assistance from the City in order to expedite the repair work.

 

On July 6, 2016 and October 19, 2016 the City Commission passed and adopted Resolution R-2016-221 and Resolution R-2016-309 which amended the One Year Action Plan for federal fiscal year 2014/2015 to allow for the expenditure of Community Development Block Grant (CDBG) funds to perform eligible capital Improvement activities.

 

This resolution proposes that the City and Washington Park Child Care Center, Inc. enter into the attached agreement wherein the City will loan CDBG funds to Washington Park Child Care Center, Inc. and the loan is to be repaid over a fifteen (15) year term.

 

Generally, when CDBG funds are invested in this manner the recipient may not change the use or planned use of any such property (including the beneficiaries of such use) from that for which the acquisition or improvement was made. Therefore the resolution also includes a Notice of Limitation of Use to be place on the property for five (5) years from project close-out.
