Explanation:

The placement of small cell antennas on utility poles or newly constructed poles in the right of way is authorized by Florida Statues and City of Hollywood Code of Ordinances. There are approximately seven (7) locations in which small cell antennas were approved and constructed around 2014. These poles were around 35’ in height and constructed to resemble nearby utility or light poles. In 2016 applications were submitted, requesting placement of poles in the right of way ranging from 50’ to 120 in height. These were rejected for not matching nearby utility poles in height and construction, with the benefit of other providers being able to conduct their business with a 35’ foot pole.

 

It is anticipated that on July 1, 2017, the State of Florida will adopt amendments to Chapter 337.401 Florida Statutes requiring local governments to allow attachments of antenna to other right of way infrastructure including light poles, limiting permit and other fees, prohibiting certain regulations related to height and minimum distance separation.

 

Staff recommends the City enter into a Pole Attachment Agreement between the City of Hollywood and T-Mobile South LLC to locate small cell antenna in light poles as identified in Exhibit B, Beautification Addendum and providing for maintenance and payment of electric power bill.
