Explanation:
US1 is under the jurisdiction of the Florida Department of Transportation (FDOT), within Young Circle that includes the parking areas and sidewalks serving several restaurants with Sidewalk Caf? Table permits.

The City and FDOT have executed a Lease Agreement, for the area covered under the sidewalk caf? permits. FDOT has requested the Lease Agreement be amended to allow for collection of annual rent in the amount of $3 per square foot, together with other amendments as discussed below. Revisions to Chapter 124 of the Code of Ordinances are proposed to eliminate conflicts between the FDOT Lease and our Code of Ordinances and allow for better administration of the Sidewalk Caf? Permits. A resolution revising the Sidewalk Caf? permit and renewal fee to match the proposed lease rate will be presented at the second reading of this item.

Chapter 124 Code of Ordinances, Sidewalk Cafes revisions include the following; listing of Development Services Department in the review process, allowing pass- through service windows where sidewalk width allows, requiring FDOT roadway design standards be used in the issuance and annual inspection of permits, requiring FDOT be added as an additional insured in the Certificate of Insurance including a new coverage for liquor liability, requiring pressure cleaning of the sidewalk at permit renewal, the ability to suspend permits as required for right of way and utility improvements and that permits be terminated in the expiration or termination of the Lease Agreement.
