Explanation:

For violations of the beach regulations set forth in Chapter 99 of the Hollywood Code of Ordinances, individuals who are issued citations are deemed guilty of a civil infraction and are required to pay the applicable civil penalty or contest the violation in court.  Such payment of the civil penalty is to be made within two (2) working days from the date of issuance of the citation of a request for a court hearing must be made.  Upon failure of the recipient of the citation to make the required payment, or request a court hearing, a demand letter requesting payment is sent by the City Attorney’s Office approximately thirty (30) days after the issuance of the citation.  The City currently has numerous unpaid civil beach citations in which no court hearing has been requested and demand letters have been sent. In order to obtain a judgment to collect on these unpaid and delinquent citations the City Attorney’s Office is required to file suit.

 

Thus, the attached Resolution seeks City Commission authorization for the City Attorney to file civil actions to collect on unpaid and delinquent civil beach citations.
