Staff Recommends: Approval of the attached Resolution.

 

 

Explanation:

On January 16, 2014, the Planning and Development Board passed and adopted Resolution No. 13-DPV-61, approving a Variance, Design, and Site Plan for a 12 unit townhome development (Lincoln Park West Townhomes) and requiring a Covenant of Unity of Title for the entirety of Lot 10 and a portion of Lot 11, Block 12. However, in order to combine the entirety of Lot 10 and a portion of Lot 11, Block 12, as required by Resolution No. 13-DPV-61, a previous Covenant shall be dissolved. The previous Covenant of Unity of Title executed on December 22, 2005, by Casa 5 Development, LLC for a vacant parcel located at 2327 and 2331 Lincoln Street (Lot 10, Block 12), states the covenant shall not be terminated, amended or revoked without the express consent of the City.

 

As such, Lincoln West LLC is currently requesting the dissolution of the Covenant of Unity of Title for.
