Explanation:

The West Lake Community Development District (the “District”) is a unit of special-purpose government established in April of 1993 pursuant to the Uniform Community Development District Act of 1980, Chapter 190, Florida Statutes, and the City of Hollywood, Ordinance Number O-93-15, its purpose being to provide community planning, management and financial services for the effective and timely delivery of capital infrastructure needs for the West Lake Village Development within the City of Hollywood, to include but not limited to water management and drainage facilities, transportation system, water and wastewater facilities, and landscaping. The District is representing that it has completed its obligations, and on August 19, 2015, the District passed a motion authorizing the termination of the District and filing of a petition to dissolve the District in accordance with Florida Statutes. Subsection 190.046(9), Florida Statutes, provides that if a district has no outstanding financial obligations and no operating or maintenance responsibilities, upon the petition of the district, the district may be dissolved by nonemergency ordinance of the City.

The City is in receipt of the petition which represents to the City that the District has no outstanding financial obligations or maintenance responsibilities. This representation is subject to the conveyance of the lake parcels owned by the District to the City by Quit Claim Deed prior to the adoption of the subject Ordinance to dissolve the District. Simultaneously, with the acceptance of the said lake parcel conveyance from the District, the City is conveying the same lake parcels to West Lake Village Homeowner’s Association, Inc. (HOA) by Quit Claim Deed, to pass on ownership, together with operation and maintenance responsibilities of the lake parcels to the HOA. Ownership, operation and maintenance of the water and sewer facilities within the District had already been transferred and remain with the City, and the ownership, operation and maintenance of all other capital improvements within the District have also been transferred and remain with the HOA. The Resolutions for conveyance of the lake parcels are intended to be companion items to the dissolution Ordinance at time of second reading, to be heard prior to the adoption of the Ordinance.
