Staff Recommends: Approval of the attached Resolution.

Explanation:
The applicant, Florida Power and Light, acting on behalf of Broward County's Port Everglades Department, is proposing to construct a new FPL substation to serve the South Port area on County- owned property legally described as Parcel A of the "Port Everglades Industrial Park Section One" Plat." The parcel is bifurcated by the FEC railroad spur, and in order to accommodate road access to the substation site to the western portion of Parcel A, an additional 50' wide ingress/egress access opening is necessary along the south side of Eller Drive, as the existing 50' access opening serving the parcel is located just east of the FEC tracks. A site design proposing an internal at-grade rail crossing is not practical when an alternative safe route exists without the need for an additional crossing.

Access openings along Eller Drive are restricted by Plat via a Non-Vehicular Access Line (NVAL) Plat Notation, and the existing NVAL and the proposed revised NVAL are more specifically identified in Exhibit "1" and Exhibit "2" respectfully, attached as part of the agenda package.

Staff has reviewed the request for code considerations and finds the proposed FPL substation plan remains consistent with the concurrency standards established for the Plat, and therefore, recommends approval. The applicant intends to file the plat amendment application with Broward County, and City Commission approval is necessary for the plat amendment to proceed at the County level.
