Title

A Resolution Of The City Commission Of The City Of Hollywood, Florida, Approving And Authorizing The Appropriate City Officials To Implement A Settlement Between The City Of Hollywood And Willie A. Humphrey In The Amount Of $100,000.00.

Staff Recommends:  Approval of the Resolution.

Explanation:

In 2014, Willie A. Humphrey filed a civil action against the City of Hollywood, Florida, arising out of an accident that occurred on or about November 28, 2013.  In the action, Mr. Humphrey alleges that while he was driving his vehicle, a City-owned vehicle driven by a City employee collided with his vehicle.  Mr. Humphrey further alleges that the accident was caused by the City Employee’s negligence and that he (Mr. Humphrey) was injured as the result of the accident.

The parties recently discovered that the negligence of another entity, Signal Technology Enterprises, Inc., may have caused the accident in whole or in part.  The City Attorney’s Office and Mr. Humphrey’s attorney have negotiated a settlement in the amount of $100,000.00, subject to the condition that the City agrees that it will not subsequently file a civil action against Signal Technology Enterprises, Inc. to recover all or a portion of the $100,000.00 that it will pay to Mr. Humphrey.

If this settlement is approved by the City Commission, the monies will be paid from the City’s self-insurance fund.

The City Attorney recommends that the City Commission approve the negotiated settlement.
