Staff Recommends: Approval of the attached Resolution.

 

 

Explanation:

Pursuant to Section 316.006(2)(b), Florida Statutes, municipalities may exercise jurisdiction over any private road or limited access road located within its boundaries if the municipality and the party owning or controlling such private or limited access road(s) provide, by written Agreement approved by the governing body of the municipality, for limited municipal traffic control jurisdiction over the road(s) included in such Agreement. This Agreement may include a provision for indemnification provided by the party seeking traffic enforcement assistance. In addition, the state statute allows for the Owner to reimburse the City for actual costs of traffic control and enforcement over the property and common areas, however, at this time the Police Department is not recommending that such reimbursement be included.

 

The attached Agreement authorizes limited municipal traffic control jurisdiction over the road(s) within the private Oakridge community. On September 16, 2015, the Hollywood Oaks Association, Inc. Board approved the execution of the attached Agreement with the City of Hollywood.
