Explanation:
In 2012, the Florida Legislature passed and adopted House Bill 337 which created Section 287.05712, Florida Statutes to provide for public-private partnerships. As part of the public- private partnership program procurement procedures, Section 287.05712 (4)(a) provides that a public entity may establish a reasonable application fee for the submission of an unsolicited proposal. In order to establish such application fee, Section 166.201, Florida Statutes requires that such fees are to be authorized by ordinance.
On second reading of the proposed Ordinance, City staff will present a companion Resolution Item which will establish the requisite fee.  Staff is recommending that the initial application fee deposit be set at $25,000.00  Additional fees may be charged based on the nature of the proposal and the complexity of the review required.  The estimated application fee shall be paid prior to the City's further evaluation of the proposal.  In addition, the City shall refund any portion of the application fee deposit that exceeds the City's cost of evaluating the proposal.
