Explanation:

On June 17, 2015, the City Commission adopted Resolution R-2015-170 (“2015 Resolution”) to amend the plat notations on the “Indigo Beach Resort” Plat located at 4000 South Ocean Drive. Part of the 2015 Resolution approved the relocation of the Bus Shelter Easement and the Landscape Buffer Easements and release of the Traffic Control Easement.

 

The current owner of 4000 South Ocean Drive, Hollywood Hotel Associates LLC, has applied to Broward County to vacate the referenced easements as per the 2015 Resolution. In processing the application, the County is requesting confirmation of the vacation of the referenced easements within the 2015 Resolution as required in Section 177.101(4) of the Florida Statutes and to obtain a certified copy of a resolution of the City showing that it has already vacated such easements.

 

As such, this resolution is necessary to confirm that the 2015 Resolution vacated the referenced easements, to provide a resolution for the easements vacation and that it is consistent with Section 177.101 of the Florida Statutes.

 

 

Fiscal Impact:

Approval of the resolution will not fiscally impact the City.
