SECOND READING:
At the May 7, 2025 meeting, the City Commission approved the proposed ordinance on first reading, subject to the incorporation of the following amendments:
1. Eliminate protest and appeal rights for as-of-right site plan requests;
2. Clarify that Administrative Variance provisions apply solely to existing developments, ensuring it cannot be applied concurrently with Administrative or Development Review Committee (DRC) Site Plan requests;
3. Add language stipulating that Site Plan requests utilizing parking in lieu provisions must be reviewed and approved by the Planning and Development Board;
4. Revise the threshold for Planning and Development Board review to include any development proposing more than ten (10) residential units or more than 20,000 square feet of gross floor area, whichever threshold is more restrictive.
Staff has incorporated the Commission's requested changes, along with minor revisions to nomenclature and internal code cross-references. It is noted that the removal of protest and appeal rights has also eliminated the requirement to issue mailed notices to property owners and residents within a 500-foot radius for Administrative and DRC-level Site Plan requests. However, public participation remains a component of the process through two mandatory public outreach meetings for DRC-level projects.
