Explanation:
The City has used Bryant Miller Olive P.A. (the “Law Firm”) to provide legal services in various labor and employment matters. The Law Firm is representing the City in pending pension litigation known as “Bien vs. City,” and in the near future, the Law Firm will be representing the City in pension litigation involving a benefit known as a supplemental distribution, or “13th Check.” The 13th Check litigation will likely be filed as three separate cases.
Section 38.40(C)(2) of the Code of Ordinances exempts from the competitive bid and competitive proposal requirements of the Purchasing Ordinance contracts for professional services. The total fees to be paid to the Law Firm for the Bien litigation and the 13th Check litigation for FY 2015 are expected to approach but not exceed $100,000.00.
Funding has been identified and will be available in the Fiscal Year 2015 budget in account # 01.0104.00000.514.003126.
