Staff Recommends: Approval of the resolution and issuance of a Blanket Purchase Agreement to Florida East Coast Railway, LLC in the amount not to exceed $4,000,000 over a 5-year term and the option to renew for one (1) additional 5-year term.


Explanation:
The City Commission has adopted resolutions for railroad crossing agreements with Florida East Coast Railway, LLC (FECR) for City streets to cross through FECR rights-of-way at nine locations.

The Resolution Numbers are as follow:
R-93-114 for Washington Street
R-72-122 for Monroe Street
R-94-32 for Harrison Street
R-93-03 for Hollywood Boulevard
R-73-113 for Tyler Street
R-68-88 for Fillmore Street
R-77-149 for Johnson Street
R-168 for Garfield Street
R-72-123 for Taft Street

The approval of the agreements has allowed the reimbursement of repair and maintenance of crossings and associated signals at each of the crossing street within the FECR rights-of-way.

Since 2021, FEC has submitted various budgetary estimates to repair crossings at Tyler Street, Taft Steet, Harrison Steet, Hollywood Boulevard, Washington Street, and Monroe Street, totaling approximately $1,200,000.00.

Upon the completion of the railroad repair and maintenance, FECR invoiced the City with the actual bill. Previous reimbursements or invoice payments to FECR for railroad crossing maintenance were made using Direct Payment Vouchers, which are no longer used by the City.
