Explanation:
On November 9, 1977, the City Commission passed and adopted Resolution No. R-77-149 that authorized the appropriate City officials to execute a license agreement with the Florida East Coast Railroad Company ("FEC") for the Johnson Street railroad crossing.

In 2021, Broward County received a Federal grant to make improvements to the Johnson Street railroad crossing area. The improvements include new traffic signals, pavement repairs, sidewalk, and ADA ramps. As the proposed improvements extend beyond the footprint of the existing Johnson Street license agreement, FEC has determined that a new license agreement is required.

The new license agreement requires the City to pay an advanced annual license fee of $9,000.00 for use of the Johnson Street crossing site. The annual license fee will increase a minimum of 3% per year. The new license agreement also includes an annual crossing maintenance fee of $8,930. Previously, the annual crossing maintenance fees were managed under a separate Railroad Crossing Reimbursement Agreement with FEC, authorized by Resolution No. R-2006-417, dated February 14, 2007. The new agreement will cancel and supersede all previous agreements.

The new FEC Johnson Street license agreement is for an initial term of one year and shall continue in effect from year to year, subject to termination by FEC or the City upon 60 days prior written notice by either party.

For the City to use the Johnson Street crossing, staff recommends that the City Commission execute the Johnson Street Railroad Crossing License Agreement with FEC.
