Body

Staff Recommends: Approval of the attached Ordinance.

Explanation:
The request to amend the permitted use list in Beach commercial zoning districts to prohibit smoke shops and adult uses is grounded in key planning principles that aim to enhance the quality of life, ensure the safety of residents and visitors, and foster a vibrant, family-friendly commercial environment. This proposed amendment follows Ordinance O-2023-16, adopted on December 6, 2023, which sought to limit the proliferation of smoke-shops in commercial areas Citywide. This particular focus on the Beach commercial zoning districts and areas east of the Intracoastal Waterway further refines the approach of maintaining a desirable and health-conscious community atmosphere.

Hollywood Beach, one of the City's most economically significant areas, boasts a unique character that appeals to both residents and tourists seeking recreational, family-friendly experiences. Prohibiting smoke shops and adult uses aligns with the goal of preserving the area's welcoming and inclusive nature. The presence of such businesses could detract from the family-oriented and recreational focus essential to the success of the beach districts. Maintaining the attractiveness and accessibility of these areas for all demographics is vital for sustaining their appeal and economic vitality.

On May 14, 2023, the Planning and Development Board acting as the Local Planning Authority heard the item and recommends that the item be brought forward to City Commission for review and adoption.
