Explanation:
The Florida Department of Transportation (FDOT), as applicant, has reapplied for the vacation of a 50' wide undeveloped right of way more particularly described in the attached Exhibit "A". The right of way parcel is adjacent and parallel to the Sheridan Street south right of way line between the CSX Railway and North 29th Avenue within their property known as the Sheridan Station Park and Ride site, which was created as public right of way in 1958. The vacation request leases out the developed portion of the right of way which was provided for under separate deed in 1965. The Florida Department of Transportation (FDOT) is looking for redevelopment opportunities at the Park and Ride site, and together with the Okomo Associates, LLC property, are planning a transit oriented project.
The FDOT previously obtained approval for the vacation of the subject undeveloped right of way parcel via Ordinance O-2008-26 on December 17, 2008, with the condition the vacation would become null and void if recordation of the "Sheridan Station" Plat did not occur within three (3) years form the date of adoption of the Ordinance. Recordation of the Plat was not timely achieved, and consequently, Ordinance O-2008-26 became null and void. The recordation of the "Sheridan Station" Plat (attached) has since been obtained as well as provisions for a combined 6' wide and 15' wide utility easement (attached) to maintain existing public utilities within the vacation area.
