Explanation:
Greenberg Traurig, P.A. ("GT") is currently representing the City on utility legal issues, primarily those involving the six large users of the Southern Regional Wastewater Treatment Plant. GT is mainly focused on continuing legal issues brought by the City of Pembroke Pines, one of the City's large users.

Section 38.41(C)(11)(i) of the Procurement Code exempts contracts for professional services from competitive bid and proposal requirements.

Considerable legal services are anticipated to be rendered by GT throughout FY 2025. The City of Pembroke Pines has filed three civil actions regarding ongoing large user agreement issues. The City is defending these civil actions vigorously and the issues are complex. GT has devoted, and will continue to devote, extensive time to the City's defense. It is virtually certain that these civil actions will continue to be litigated for several years to come.

The Department of Public Utilities requested a proposal from GT for legal services in an amount up to $500,000.00. GT responded with the attached FY 2025 agreement, which would authorize the payment of fees in an amount up to $500,000.00 for the matters set forth in the agreement.


Fiscal Impact:
Funding for this agreement will be available in the FY 2025 Operating Budget in account number 442.400101.53600.531220.000000.000.000, subject to approval and adoption by the City Commission.
