Second Reading:
This item passed on first reading with the language to identify where the tree is measured at (Diameter at Breast Height or DBH). This is the only change (Section106.26 B.1) to the ordinance since first reading, which now reads:
Provisions of division (A) remain applicable to trees with trunk diameter of three inches or more and measured 4.5 feet above grade (Diameter at Breast Height or DBH).
First Reading:
Chapter 106 of the Code of Ordinance sets forth regulations regarding trees and establishes the guidelines and parameters for tree removal. The Department of Development Services/Engineering, Transportation and Mobility Division staff have been reviewing the regulations under Chapter 106 and have determined certain provisions need to be updated. These recommended revisions are applicable to Section 106.26. The revisions are as follows:
106.26 PERMIT REQUIRED TO DESTROY OR REMOVE; EXEMPTIONS.
(B) Owner-occupied properties developed for detached single-family usage are exempt from all of the provisions of this chapter except as follows:
(1) Provisions of division (A) remain applicable to trees with trunk diameter of two three inches or more and measured 4.5 ten feet or more in height above grade.
(3) Where a tree is to be removed from the property without being relocated, the city shall be notified and given the option to relocate the tree elsewhere at no cost to the property owner.
Fiscal Impact:
Approval of this Ordinance will not fiscally impact the City.
