SECOND READING:
During first reading the City Commission requested adding the verbiage “unfiltered’ when applied to “cigar” to the language for the second reading.
FIRST READING:
The Florida Legislature passed House Bill (“HB”) 105 during the 2022 legislative session, referred to as the “Florida Clean Air Act”. HB 105 specifically authorizes Municipalities to regulate and prohibit smoking within the boundaries of City Parks.
Currently, the City ordinance does not prohibit smoking cigarette, cigars, pipes or tobacco products in municipal parks and playgrounds. The exposure to second-hand smoke has been linked to cancer and other fatal diseases.
The Parks, Recreation and Cultural Arts (“PRCA”) Department believes that municipal parks and playgrounds should operate “smoke free” to promote public health and safety for all residents and youth. Municipal parks include athletic fields, skate parks, aquatic facilities and other recreation facilities.
Amending Section 103.03(C) will prohibit all visitors, residents and youth from smoking cigarettes, cigars, pipes or tobacco products in municipal parks and playgrounds.
Fiscal Impact:
Approval of this Ordinance will not fiscally impact the City as it is a proposal to prohibit smoking cigarette, cigars, pipes or tobacco products in municipal parks and playgrounds.
