Staff Recommends: Approval of the attached Ordinance.
Explanation:
SECOND READING:
During first reading the City Commission requested adding the verbiage “unfiltered’ when applied to “cigar” to the language for the second reading.
FIRST READING:
The Florida Legislature passed House Bill (“HB”) 105 during the 2022 legislative session, referred to as the “Florida Clean Air Act”. HB 105 specifically authorizes Municipalities to regulate and prohibit smoking on municipal beaches and parks.
Currently, the City ordinance does not prohibit smoking cigarette, cigars, pipes or tobacco products on the City’s beaches. The exposure to second-hand smoke has been linked to cancer and other fatal diseases.
The Parks, Recreation and Cultural Arts (“PRCA”) Department believes that the City’s beaches should operate “smoke free” to promote public health and cleaner beaches.
Amending Section 99.03(S) will prohibit all visitors, residents and youth from smoking cigarettes, cigars, pipes or tobacco products at City beaches.
Fiscal Impact:
Approval of this Ordinance will not fiscally impact the City as it is a proposal to prohibit smoking cigarette, cigars, pipes or tobacco products on City beaches.
