Explanation:
Pursuant to Resolution No.R-2009-131, the City Commission authorized the appropriate City Officials to negotiate and execute an Agreement with American Traffic Solutions (“ATS”) for a traffic safety camera enforcement program. The City and ATS executed an Agreement on May 3, 2010 and the program has been in effect since January 2011.
Section 6.1 of Article VI of the Agreement provides that the City may terminate the Agreement with or without cause. After evaluating the program, the Interim Police Chief is recommending that the Agreement be terminated without cause.
Pursuant to Section 38.48(A) of the Purchasing Code, the City Commission must authorize the termination of a contract when it is without case and such decision requires at least a 57ths affirmative vote.
