Explanation:
Florida Statute § 943.175(1) requires law enforcement agencies to develop and implement in-service training for employees of the agency. The Hollywood Police Department operates a professional and well-trained Special Weapons and Tactics team, along with other specialized units. On September 21, 2016, the City Commission executed resolution R-2016-281, authorizing the City Manager and his designees to execute indemnification agreements or “hold harmless” agreements with private property owners within the City of Hollywood, when said agreements are required by private property owners in exchange for allowing the Police Department to conduct training on owner’s property.
The Police Department also participates in training exercises outside the City of Hollywood, such as training exercises hosted by other law enforcement agencies, which provides great value to the Police Department. The owner(s) of the facilities will often request the execution of a “hold harmless” or indemnification agreement, in exchange for allowing the Police Department to participate in training on the property. The act of indemnification is a power reserved to the City Commission, except to the extent that the Commission delegates that authority to others in specific circumstances. Time is of the essence regarding these agreements, because the opportunities often arise without sufficient time to bring the agreement before the City Commission.
