Explanation:
On March 1, 2023, the Community Redevelopment Agency (“CRA”) Board adopted Resolution R-CRA-2023-12 ranking Construction Management at Risk (“CMAR”) firms in response to Request for Qualifications RFQ-005-23-GJ (“RFQ”) and authorizing the execution of certain agreements for an initial three-year term with the option to renew the agreement for two subsequent one-year terms.
Section 2.9 of the RFQ states that the contract period shall be a five (5) year term with the option to extend by the CRA for two (2) additional one (1) year periods.
Resolution No. R-CRA-2023-12 contains a scrivener’s error in the ninth “WHEREAS” clause stating that “… the initial term for the agreements will be for three years…”.
Section 3.2 of the RFQ states that the “… CRA intends to use two separate contracts for CMAR project as assigned. The first contract would be for the Pre-Construction Services (Phase I) and the second would be for Construction Services (Phase II) …”.
Resolution No. R-CRA-2023-12 contains a scrivener’s error in the resolution title, the eleventh “WHEREAS” clause, and Section 3 regarding the authorization to execute Phase I Preconstruction Agreements with the highest ranked firms.
To be consistent with the RFQ, the CRA Board wishes to correct the scrivener’s error in the duration of the initial term of the agreements from three years to five years, to authorize the execution of Phase I Pre-Construction Services Contracts and/or Phase II Construction Services Contracts, and to authorize...
