Explanation:
On December 6, 2023, pursuant to Resolution No. R-2023-410, the City Commission authorized the appropriate City officials to execute a contract with Cardinal Contractors, Inc. ("Cardinal") for construction services related to the Oxygenation Flow Distribution Box Odor Control System Replacement Project at the Southern Regional Wastewater Treatment Plant, in the amount of $3,131,010.00.

On December 3, 2025, the City Manager approved Change Order No. 3, granting Cardinal an 84-calendar-day non-compensable time extension due to unforeseen site conditions and vendor delays, in accordance with Section 38.48 of the Procurement Code.

Subsequently, Cardinal faced additional project delays due to extended vendor lead times for critical equipment and materials. These delays affected the project schedule and made it more difficult to coordinate equipment installation, testing, startup, and operator training. Adverse weather conditions also slowed the project.

Cardinal requested an additional 120 calendar days, providing documentation to demonstrate that these unexpected delays affected the project's critical path. Hazen and Sawyer, P.C., serving as Construction Manager and Engineer of Record, together with Department of Public Utilities staff, reviewed the request and determined that the additional 120 calendar days of non-compensable time was fair and reasonable.
